Introduction and acceptance of the General Conditions of Sale

These general terms and conditions (hereinafter also "General Conditions") govern the offer by 3ND S.r.l. (hereinafter also "Enoteca Compagnucci") of products on www.enotecacompagnucci.com (hereinafter also "Site"). The General Conditions must be accepted by the User when registering on the Site, in order to be able to take advantage of the offers made therein and to proceed with the purchase of products.

Enoteca Compagnucci reserves the right to modify at any time in whole or in part the General Conditions, notifying Users via the Site with at least 30 days notice, if the methods of use of the products and services offered have changed. The products on the Site are resold by Enoteca Compagnucci directly, also in the form of drop-shipping (hereinafter also "Direct Sale" ) or by commercial partners (hereinafter also "Partners") of Enoteca Compagnucci. Site Registration

The Site is aimed exclusively at Users who have reached the age of 18. Navigation and use of the services offered within the Site are made accessible after the registration procedure.

Registration is free. Users who register on the Site must provide some personal data and follow all the steps from the procedure (hereinafter also "Complete Registration"). Conditions of the offer

The object of Enoteca Compagnucci's offers is the purchase of goods at the prices indicated on the Site. Enoteca Compagnucci reserves the right not to process orders from subjects other than the "consumer" in accordance with its commercial policy. In any case, Enoteca Compagnucci does not sell alcohol to individuals who have not reached the age of 18. Prices are expressed in Euros and are inclusive of VAT. The shipping costs of the goods can be fixed or variable, calculated based on the weight, the number of items selected and / or the destination address of the goods. Purchase procedure and payment methods

Having acknowledged the conditions of the offer, the User can complete the purchase by following the procedure on the Site.

Following the successful completion of the payment, the User will receive a confirmation email containing information relating to the offer purchased. The email will also contain a reference to these General Terms and Conditions. The confirmation will contain a summary of the delivery and billing address. The shipment of the goods takes place within the times indicated in the order confirmation. Delivery times are also indicated before concluding the purchase procedure in the cart summary or on the product page. The accepted payment methods, unless otherwise specified or agreed with the User, are: credit card and prepaid cards of the Visa, Mastercard, Maestro, Postepay, American Express, Discover (Diners Club International and Pulse) circuits, with PayPal, Apple Pay and bank transfer accounts. Enoteca Compagnucci may, in some or all cases and at its sole discretion, offer the alternative payment method by cash on delivery (in cash upon delivery of the goods).

The amount due is debited, unless otherwise specified in the terms of the offer, upon confirmation of payment. In the case of a bank transfer, at the time of order confirmation, the bank details (IBAN), the amount of the transfer and the order number will be indicated. Payment by bank transfer must be made within the terms possibly indicated and in any case no later than 2 days from the order confirmation, a deadline beyond which it may not be possible to guarantee the evasion of the goods: in this case Enoteca Compagnucci will re-credit the sender, at no additional cost and by bank transfer, any payment received after the deadline.

In the case of Subscription Service, the User authorizes Enoteca Compagnucci to periodically debit the amount on the credit or prepaid card. In this regard, the User declares and guarantees the availability of the sum necessary for the payment of the fee.

If the User realizes that he has provided incorrect and / or incomplete information about his personal details or the shipping address of the goods, it is necessary that he communicate it promptly and within the terms of order fulfillment, by sending an email at info@enotecacompagnucci.com. In all cases, the User is solely responsible for any indication of incorrect and / or incomplete general information or delivery address, resulting in the possibility of losing the sum paid if the goods are delivered to strangers.

Security in transactions

Enoteca Compagnucci is very attentive to the safety of its Users. Enoteca Compagnucci does not process and does not keep the data of the payment instruments (e.g. credit card numbers), which are processed and / or stored by the relative payment service providers. The actual payment takes place through fields for entering the protected and encrypted payment data, served directly by the Shopify Payments payment service.Only after the transaction has taken place, the banking service provider communicates the outcome of the payment to Enoteca Compagnucci, without providing any sensitive information. For this reason, Enoteca Compagnucci has no power over any refusal of the credit card used for payment. Enoteca Compagnucci cannot therefore be held responsible in any way for direct or indirect consequences arising from the use of the credit card by the user to pay for the products and / or services purchased.

Coupon

Enoteca Compagnucci can issue discount codes (hereinafter also "Coupon") that the User can use when purchasing products. Coupons are issued in the form of an alphanumeric code and their value (in euros) is determined unquestionably and at its own discretion by Enoteca Compagnucci. The Coupon can be entered by the User in the appropriate "Coupon" field when entering the order. The coupon thus entered will be automatically deducted, and before payment, from the total amount of the order excluding any shipping costs. Coupons with percentage discounts are not applied to products already in promotion. Coupons are generally usable by the user for a limited period of time, after which they will no longer be usable. The Coupon may be subject to a minimum amount of expenditure under which its use will not be possible. Unless otherwise specified, the Coupon is personal and linked to the User's Account and can be used for a single purchase, after which it will be automatically invalidated. Shipping and delivery

Enoteca Compagnucci and its partners, if any, accept orders with delivery exclusively to the Italian territory, including the islands, with the exception of San Marino, Vatican City, Livigno and Campione d’Italia.The shipment of the goods takes place within the maximum time indicated in the conditions of the offer and, for timed offers (flash-deal), it could start from the end of the same. Enoteca Compagnucci cannot guarantee that several products purchased at the same time are delivered with a single shipment, nor that any different shipments arrive at their destination at the same time. The offers, in fact, may refer to products supplied by different Partners and / or not come from a single centralized warehouse. It is not possible to guarantee a precise delivery date or time as this depends on the courier, the destination address and the person in charge of delivery. Enoteca Compagnucci cannot therefore be held responsible for any direct or indirect consequence deriving from these times. The delivery of the order is intended, unless otherwise specified during the purchase process, on the street level.

In the case of shipping bottles, Enoteca Compagnucci uses patented packaging approved by the courier, designed to ensure the integrity of the product. In any case, upon delivery of the goods by the courier, the User will be required to verify that the packaging is intact, not damaged, or otherwise altered, even in the closing materials (adhesive tape or strapping) or that there are no liquid leaks. Any damage to the packaging and / or to the product must be immediately contested by the User, placing a written reservation of control (and specifying the reason for the reservation, eg. Product conformity guarantee

Enoteca Compagnucci works diligently and in absolute good faith in selecting suppliers and Partners, verifying their actual suitability to supply the products in the quantities and according to the characteristics described in the purchase offers, it being understood that Enoteca Compagnucci cannot be responsible for personal injury resulting from any violation by the manufacturers. In any case, Enoteca Compagnucci cannot guarantee the completeness or the content of the information provided by the Supplier or the Partner, nor the perfect correspondence of what is described in the product or offer sheet with the product actually delivered, as well as the legitimacy of the use by the Supplier or Partner of images, videos and distinctive signs. The User is also aware that the images used on the proposals can sometimes only be indicative of the product and not always faithfully represent the delivered product. In the case of Intermediate Sale, and therefore of products supplied directly by a Partner, the latter will be solely responsible for the conformity of the products under warranty. Any complaints must be sent directly to the Partner by email to the address contained in the purchase confirmation and for information also to info@enotecacompagnucci.com. The Partner will indicate the methods of verification, repair or replacement of the goods, or to authorize Enoteca Compagnucci to issue a refund in favor of the User. In the case of Direct Sales, Enoteca Compagnucci will be directly responsible for the conformity of the products under warranty. Withdrawal

The User who requests a service for purposes unrelated to his professional activity has the right to withdraw from the purchase contract concluded with Enoteca Compagnucci or with the Partner without any penalty and without having to provide any reasons, within 14 working days pursuant to and for the effects of art. 52 paragraph 1 of the Consumer Code, which run from the day of receipt of the product purchased on Enoteca Compagnucci.The withdrawal may be exercised by the Customer, pursuant to Article 54 paragraph 1 of the Consumer Code, using the withdrawal form referred to in Annex I, Part B of the Consumer Code or using the one available at the link: content / right-withdrawal or by submitting any other explicit declaration of your decision to withdraw from the contract, to be sent either by letter with return receipt, to CAM Srl, via benedetto costa 30, 62028 - Sarnano (MC) or by email to info@enotecacompagnucci.com or, in the case of Intermediate Sale, also to the Partner's email address indicated on the purchase confirmation page and also present in the User Account, also making known Enoteca Compagnucci. Following the correct exercise of the withdrawal, unless Enoteca Compagnucci or the Partner does not collect the goods directly, the User will have the obligation to return the goods without undue delay and in any case within 14 days from the date on which the 'User has communicated to Enoteca Compagnucci or the Partner his decision to withdraw from the contract pursuant to art. 54, c. 4. The User must visibly apply the document received by Enoteca Compagnucci following the aforementioned withdrawal notice on the packaging, in which the shipping address and the details relating to the order necessary to identify the return at destination. The User is advised to insert a copy of this document also inside the packaging, in order to avoid its loss or the inability to identify the return once it has arrived in the warehouse. The relative shipping costs of the goods will be borne by the User, except in the case where Enoteca Compagnucci has not informed the same about it at the time of the conclusion of the contract, in accordance with art. 57 paragraph 1 of the Consumer Code.

The goods must in any case be kept, handled and inspected with normal diligence and returned intact, complete in all their parts, accompanied by all accessories and leaflets, identification tags and original labels, where present, still attached to the goods and intact and not tampered with, as well as perfectly suitable for their intended use and free from signs of wear or dirt.

As required by art. 57 paragraph 2 of the Consumer Code, the User is responsible for any decrease in value resulting from the handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods. In this case, Enoteca Compagnucci, upon written communication to be sent to the User within 5 working days of receipt of the goods, may reduce the amount of the reimbursement due to this decrease in value, providing the same, in the event that the reimbursement has already been paid, the bank details for the payment of the amount owed by the User due to the decrease in value of the asset.

Enoteca Compagnucci can refuse to accept a withdrawal for food products that have been consumed even partially. Pursuant to art. 59 of the aforementioned Consumer Code, goods made to measure or personalized or which, by their nature, cannot be returned or are subject to rapid alteration or deterioration are excluded from the possibility of withdrawal.

Exceptions of the right of withdrawal

It is understood in any case that, with reference to the provision of services, the right of withdrawal cannot be exercised by the User after the complete supply of the products by Enoteca Compagnucci if the supply itself has begun with the express agreement of the User and he has accepted to lose the right of withdrawal following the full execution of the service by Enoteca Compagnucci

In any case, pursuant to art. 59 of the Consumer Code, goods made to measure or personalized or which, by their nature, cannot be returned or are subject to rapid alteration or deterioration are excluded from the possibility of withdrawal.

Refunds

Any disbursement of sums by way of reimbursement by Enoteca Compagnucci, if due, will take place pursuant to Article 56 paragraph 1 of the Consumer Code as soon as possible, and in any case no later than 14 days from the date in which the event that gave rise to the reimbursement occurred and in the event of withdrawal, from the day on which the User became aware of the relative exercise. Enoteca Compagnucci will reimburse using the same payment method used by the User for the initial transaction, unless otherwise expressly agreed with the User and provided that the same does not incur any costs as a result of using the different means of payment. If the User has expressly chosen a different type of delivery that provides for delivery costs higher than those related to the standard delivery offered by Enoteca Compagnucci ("Additional Costs"), the latter will not be required to reimburse the related Additional Costs. It is understood that, with the exception of cases in which Enoteca Compagnucci has decided to collect the goods directly, Enoteca Compagnucci may withhold the reimbursement until it has received the goods or until the User has demonstrated that he has returned the goods, depending on which situation occurs first.

Responsibility of Enoteca Compagnucci

Enoteca Compagnucci will not be liable for damages that may derive from the use of the Site such as computer viruses, omissions, service interruptions and software failures, even to the detriment of the User's computer equipment, which prevent or delay the provision of services if these are due to external causes, force majeure and / or third parties not dependent on the will of the owner. Industrial and intellectual property

These General Conditions will be governed in every aspect by Italian law.

For any dispute concerning the interpretation, execution and / or termination of the contract between the User and Enoteca Compagnucci, in the case of Direct Sale, or between the user and the Partner in the case of Intermediate Sale, the Parties acknowledge that the Judge of the place of residence or domicile of the User will be competent, if the same is to be considered a "consumer" according to the laws in force on the matter. If, on the other hand, the User is a professional, in the case of Direct Sale the Court of Macerata will be competent, while in the case of Intermediate Sale the Court of the Partner's place of residence will be competent.

Alternative dispute resolution (so-called Alternative Dispute Resolution / On Line Dispute Resolution) and Netcomm Joint Conciliation

Enoteca Compagnucci informs the consumer User pursuant to article 141-sexies of the Consumer Code that, if he has presented a complaint to Enoteca Compagnucci, but has not been satisfied with the outcome of the same or has not received a reply within 30 days, it can start the joint conciliation procedure set up by the Netcomm Consortium. The User can find more information on this procedure as well as the link to the relevant regulation at http: //www.consorzionetcomm.it / Spazio_Consumatori / Conciliation-Equality / Conciliation-Equalitykl. The application form must be sent to conciliazione@consorzionetcomm.it or by fax to the following number: +39 02 87181126. The conciliation procedure before the Netcomm Consortium will be carried out in accordance with Article 49 paragraph 1 letter V of the D . Lgs 6 September 2005 n. 206 (Consumer Code).

Enoteca Compagnucci also informs the consumer User that with EU Regulation 524/2013 of 21 May 2013 a European platform was established for the online resolution of consumer disputes, reachable at the following address http://ec.europa.eu/consumers/odr / ("ODR Platform"). Through the ODR Platform, the consumer will be able to consult the list of ADR bodies, find the link to the website of each of them and start an online resolution procedure for the dispute in which he is involved.
